    Terms of Service

    These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "you" or "your") and CosmicFlow Labs LLC ("Company," "we," "our" or "us"), governing your access to and use of:

    • The HerHabits mobile application (the "App"), and
    • The HerHabits website at herhabits.app and associated pages (the "Website").

    1. Eligibility

    1.1 The App and Website are intended for individuals who are at least 13 years of age.

    1.2 If you are under the age of 18, you must have the consent of a parent or legal guardian to access or use the App.

    2. Description of Services

    2.1 The App provides users with tools to track menstrual cycles and associated habits for personal wellness purposes.

    2.2 The Website provides information about the App, including marketing content, blog articles, and support resources.

    2.3 Both the App and Website are provided for personal, non-commercial use.

    3. License and Restrictions

    3.1 Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on compatible devices and to access the Website.

    3.2 You may not copy, modify, distribute, sell, or reverse-engineer any part of the App or Website.

    4. Purchases and Payment

    4.1 The App offers premium features through the Apple App Store.

    4.2 All payments are processed by Apple and facilitated via RevenueCat, which we use to manage in-app purchases and provide access to premium features.

    4.3 You agree that all billing and refund issues will be handled in accordance with Apple's terms and policies.

    5. Data Storage, Privacy, and Analytics

    5.1 Except for anonymous purchase metadata used by RevenueCat to validate your access, the Company does not collect, transmit, or store any personal or health data from the mobile app outside your device.

    5.2 All data generated within the App relating to your health and habits is stored locally on your mobile device. CosmicFlow Labs LLC does not have access to this data and cannot recover it for you. You are solely responsible for backing up your data. Deleting the App or changing devices without using the App's backup/import functionality or external device backups will result in the loss of your data.

    5.3 The Website uses Mixpanel for product analytics to understand how visitors use the site. By using the Website, you consent to this analytics collection. No health or habit data from the App is collected through the Website.

    5.4 Use of the App and Website is also governed by the Company's Privacy Policy.

    6. User Conduct

    6.1 You agree that your use of the App and Website will be in compliance with all applicable laws and regulations.

    6.2 You agree not to use the Website to scrape content, interfere with its operation, or use it for any unlawful purpose.

    7. Intellectual Property

    7.1 All rights, title, and interest in and to the App, Website, and their content are owned by the Company or its licensors. Nothing in these Terms transfers any ownership rights to you.

    8. Medical and Wellness Disclaimer

    8.1 The App and Website provide information for educational and informational purposes only and are not intended to be a substitute for professional medical advice, diagnosis, or treatment.

    8.2 Always seek the advice of a qualified healthcare professional with any questions regarding your health.

    9. Warranty Disclaimer

    9.1 The App and Website are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.

    10. Limitation of Liability

    10.1 CosmicFlow Labs LLC shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of the App or Website.

    11. Indemnity

    You agree to indemnify and hold harmless the Company from and against any claims arising from your use of the App or Website, or violation of these Terms.

    12. Governing Law

    12.1 These Terms shall be governed by the laws of the State of North Carolina, United States.

    13. Modifications to Terms

    We may update these Terms at any time. The "Last Updated" date at the top will reflect any changes. Continued use after changes constitutes acceptance.

    14. Entire Agreement

    These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the App and Website.
